Namakina Terms of Use

Welcome to Namakina.
We're your concierge for transformation in your career, beauty, travel, and life itself. But before we help you rewrite your story, we need to get our legal footing set.
These Terms form a binding agreement between you ("you" or "User") and Namakina, LLC ("we," "us," "our," or "Namakina"). By using our websites, apps, AI assistant, tools, quizzes, SMS/phone concierge, email flows, or any other service carrying our brand (the "Services"), you agree to these Terms, our Privacy Policy, and any additional terms we present.
Heads-up: Nothing in Namakina is medical, legal, financial, or mental-health advice. Use your judgment and consult licensed professionals when needed.

If any additional terms conflict with these Terms, those additional terms govern for their specific service or feature.
What Namakina Is (and Is not)
We're here to help you transform—but we are not:
- A therapist or mental health provider or advisor
- A medical provider
- A licensed financial or legal advisor
All Namakina tools, AI responses, insights, and services are informational, inspirational, and lifestyle-based. You're responsible for decisions you make based on our recommendations.
If your journey includes health, trauma, or risk-sensitive issues, we urge you to consult licensed professionals.
Namakina is not a HIPAA-covered entity and does not provide medical services. We do not hold ourselves out as bound by HIPAA. When using our services, you agree not to submit protected health information (PHI). If you choose to share health-related details, you authorize us to process them under our Privacy Policy—not under HIPAA.
Eligibility & Accounts
To use Namakina, you agree:
- You are 18+.
- You are a US citizen, located in the U.S. and are not legally restricted from using our services.
- You will maintain a single account in your name and keep your info current.
- You'll keep credentials confidential and notify us of suspected misuse. You're responsible for activity on your account.
- You have not been previously removed from our services or our Affiliate's services, unless you have express written consent to create a new account.
We may suspend or terminate access if eligibility changes or rules are violated.
License to Use the Services
Subject to these Terms, we grant you a limited, personal, non-transferable, revocable license to access and use the Services for their intended purpose. We reserve all rights not expressly granted. We may place or display recommendations, offers, or advertising within the Services.
AI + Your Data
How We Use AI
Namakina uses AI to:
- Recommend wellness experiences, beauty upgrades, coaching, travel, and products
- Personalize follow-ups (SMS, email, chatbot, or concierge)
- Learn from your emotional and behavior patterns
Our AI may respond based on past interactions, user trends, or even your uploaded quiz results. But it's still AI. Sometimes it'll be brilliant; sometimes it'll make mistakes. You accept that and you'll use it at your discretion.
How We Use Your Data
By engaging with Namakina, you allow us to:
- Store and process your interactions (including chats, answers, uploads, and calls)
- Use anonymized/aggregated data to improve recommendations and future interactions
- Train and refine models and tools under strict privacy controls
We may share your data with partners and affiliates when necessary to fulfill a booking or referral, under confidentiality terms. We may share or sell your information to trusted partners so they can contact you about products or services you might like. Depending on where you live, you may have the right to opt out of these activities. More information about your data, the steps we take to protect it, and your rights regarding that data can be found in our Privacy Policy.
Contribution, Reviews, and Feedback
We love it when you share content—photos, comments, testimonials, reflections. By doing so, you:
- Keep ownership
- Grant us a royalty-free, global license to share, adapt, and use it (for content, insights, or marketing)
- Agree not to post anything hateful, obscene, unlawful, or unsafe.
We may lightly edit or remove anything that doesn't align with our vibe (read: safe, kind, smart, soulful).
Our Content & Intellectual Property
The Services and all related content, trademarks, logos, code, and design are owned by Namakina or our licensors and protected by IP laws.
Standards, Safety & Reporting
We love pushing your boundaries in life, but not here. You may not:
- Harass, exploit, or dox anyone
- Post hateful, obscene, or unlawful content
- Promote self-harm, medical misinformation, or dangerous activities
- Hack, scrape, clone, or crawl Namakina or its users
- Impersonate others or misrepresent your identity or qualifications
- Promote misinformation, hate, violence, or exploitation
- Harvest, or bulk-export content or metadata
- Use bots or automation to interact with the Services or APIs without written permission
- Use our name or likeness in misleading ways
- Use the Services, outputs, or any Namakina content/data to train, fine-tune, benchmark, or improve external AI/ML systems or datasets
- Circumvent technical controls, rate limits, or access restrictions
- Interfere with, test, reverse-engineer, or overload the Services
We may suspend, terminate, or take legal action for violations.
Report issues
Use in-product tools or email hello@namakina.com. If we believe there's risk of harm, we may act on- and off-platform, including with partners or authorities where legally appropriate.
Moderation
We may remove or refuse content that violates these Terms, is unsafe, or conflicts with our policies, and may suspend repeat violators.
Third-Party Services & Links
Though your journey is your own, we will share hyper-personal recommendations with you for experiences provided by trusted partners. If we provide a link or refer you to a bookable service (spa, retreat, swimming with sea turtles), keep in mind:
- Third parties deliver the service and set their own terms and policies
- We aren't responsible for their acts, omissions, or availability
- Refunds and issues follow the third party's policies unless we state otherwise
Bookings, Sales, and Refunds
Namakina Services
Regarding refunds, in general:
- Except where stated or required by law, payments are non-refundable.
- Platform Purchases. Refunds for Apple/Google purchases must go through those platforms.
- Regional Rights. Where applicable (e.g., certain EU/EEA rights of withdrawal for digital content, specific national renewal/notice rules), we will comply with local law. See checkout disclosures and our Privacy Policy for details.
Experiences, Services, and Bookings through our links and partners
Some of our offerings, coaching programs, wellness bookings, and other experiences involve external providers. For those:
- We act as a referrer or booking concierge.
- You agree to their terms (they're the ones delivering the service).
- Refunds follow their policy unless otherwise stated.
We'll always aim for fair outcomes but we can't refund what we don't control.
TCPA Consent for SMS/MMS/Phone (U.S.)
We want your conversations with your AI coach to flow effortlessly, so we use SMS as part of our service. By providing a phone number and opting in (e.g., checking a box, replying "YES," or otherwise clearly consenting), you agree that Namakina and its service providers may send you SMS/MMS messages about your account, bookings, reminders, recommendations, and promotional content. We may also use it to identify you as a user in our system.

- Cost: Message and data rates may apply
- Opt-out: Reply STOP to end
- Help: Reply HELP for assistance
- Consent is not required to purchase or use our Services
- Carrier disclosure: Carriers aren't liable for delayed or undelivered messages
Accessibility (WCAG)
We're working toward current WCAG conformance. If you encounter a barrier or need an accommodation:
- Email hello@namakina.com with "Accessibility" in the subject
- Include the page, feature, or interaction and any assistive tech used
We'll do our best to help and improve continuously.
Data Sales, Sharing, Targeted Advertising
Under laws in some US states, "sell" or "share" can include making personal information available to a third party for monetary or other valuable consideration (including for cross-context behavioral advertising). Namakina may sell or share personal information for the purposes described in our Privacy Policy including analytics, marketing, advertising, partnership fulfillment, and others.

- Access, Deletion, Correction, Portability, and Appeal
Minors
We do not knowingly sell/share personal information of users under 18 without affirmative authorization.

Disclaimers
We're building beautiful, life enriching tech, but Namakina is offered "as-is." We can't guarantee:
- That our advice will genuinely change your life (we hope it does)
- That the AI will always be right (it's learning and makes mistakes)
- That the app, site, or concierge will be glitch-free, 24/7
No warranties. No promises. Just our best effort, plus your best judgment.
Limitation of Liability
To the fullest extent allowed by law:
- Namakina is not liable for indirect, incidental, punitive, or consequential damages
- Our total liability for any claim is capped at the amount you paid us in the past 90 days, or $100 if you paid nothing
- We are not responsible for third-party services, missed bookings, or emotional decisions made at 2am after a quiz result shook you.
If you're in a jurisdiction where these limits don't apply, local law wins.
Dispute Resolution; Arbitration; Class Waiver
Let's aim for calm conversation first. But if we must go legal:
- This agreement is governed by New Hampshire law.
- Any disputes must be resolved via binding arbitration in Rockingham County, NH.
- No class actions. Just you and us, directly.
You agree to waive your right to a jury trial and participate only in individual claims.
Ending the Journey: Termination & Enforcement
We love having you around, but you can deactivate anytime. Just say the word.
We can also suspend or terminate your access if:
- You violate these Terms or applicable law
- Your account creates risk for us or others
- We discontinue all or part of the Services
Upon termination, licenses end and certain sections (e.g., IP, Disclaimers, Limitation, Disputes) survive. Fees already paid are generally non-refundable unless required by law.
Updates to These Terms
We're on a journey of growth too, so we may update these Terms periodically. When we do, we'll revise the "Last Updated" date and, if changes are significant, notify you by email or in-product notice. Using Namakina after an update means you agree to the new Terms.
Final Word: Trust Is the Moat
We built Namakina to serve transformation, not manipulation. This is a platform designed to help you make powerful, life-enhancing choices. We take that responsibility seriously. By using our platform, you agree to be a co-creator in this experience—honest, aware, and respectful of our tech, team, and community.
