What this Policy covers (and what it doesn't)
This Privacy Policy explains how Namakina and the companies we work with handle personal information when we act as the "data controller"—meaning we decide why and how the data is processed.
It doesn't cover how our customers use Namakina products or services to process personal data for which they are the data controller. In those situations, we act as a "data processor." The customer decides what personal data to process and how to process it, and we handle it only on their instructions and in line with our contracts and applicable law.
This Policy describes how we use and protect personal data all over the world. If you live or work in a place with specific rules (certain countries, states, or territories), check the regional notices later in this Policy for extra details that apply to you.
Where your data lives
Our Sites are hosted in the United States and follow U.S. federal and New Hampshire state law. If you use the Sites from another country, you're transferring your information to the U.S. and agreeing to that transfer. If using the Sites would be unlawful where you are, please don't use them.
What we collect and how we use it
It goes without saying that to support your transformation journey, we need certain details from you when you set up an account and as you engage deeply with our AI-powered assistant. Using the service also creates data, like when you log in and how you interact with features. We may collect information from third parties as well, such as when you access the service through another platform (e.g., Facebook, Google, or Apple) or when you upload content like a photo.

- You provide some data directly, in one or more ways:
- Through interactions with our AI assistant, quizzes, and other activities. This might happen on our website, SMS, or mobile app. Through these interactions, we collect your prompts, messages, and related metadata. We use this to understand your goals (e.g., experiences to seek, habits to change, outcomes you're pursuing), encourage you along your path, and to recommend activities, products, and services (our own and, where appropriate, third-party options.) We also use this data to operate, troubleshoot, and improve the assistant and overall experience.
- Through other interactions with your consent. This could include the upload of an image of your current self, to use AI to help visualize your future ideal self. It might include video to analyze emotional state during interactions. Some of this data might be considered biometric data in some locations, please see our privacy policy for more information about rights that might apply to you.
- We collect some data automatically. Like many sites, we receive technical details such as your IP address, browser and operating system, pages you visited before/after our Sites, and cookie-based insights about how you navigate. Cookies help us understand usage so we can improve content and usability.
- We generate some data as you use our services. This can include usage data like how you interact with the site and applications, what information is shown to you, or how you interacted with ads. It can also include technical data like traffic, devices you use to connect, and others. It can also be data we generate from the data you share with us directly, like summaries of your interactions with the AI assistant.

How long we keep your personal data

If you're under 18. If you have a registered account with us and you're under 18, you can ask us to remove personal information you posted publicly on the Sites. Contact us using the details below and include your account email and a statement that you're a California resident.
"Shine the Light" law. California residents may request, once per year and free of charge, information about any personal information we shared with third parties for their direct marketing in the prior calendar year (including categories of info and the third parties' names/addresses). International transfers of personal data
If we ever move your personal data outside the EEA, UK, or Switzerland, we do so on the basis of the European Commission's adequacy decision for the EU-U.S. Data Privacy Framework (DPF), which we conform to. In practice, that means we only transfer your data to U.S. organizations that are DPF-certified, which the Commission has determined offers an adequate level of protection.

Your EU regional privacy rights
Local laws may give you rights such as:
- Access to your information (and a copy of it)
- Correction of your information
- Deletion of your information

- Withdrawing consent at any time (this won't affect processing that happened before withdrawal)

Children's privacy (COPPA)
Per our Terms of Service, we don't knowingly collect or keep personal information from children under 18. Anyone who provides information through the Sites confirms they're 18 or older. If we learn we collected information from an individual under 18, we'll delete it.
Parents/guardians of an individual under 18 who used the Sites: please contact us at hello@namakina.com to close the account and delete the child's information.
Do Not Track
Some browsers and mobile OSs send Do‑Not‑Track (DNT) signals. There's no common standard for interpreting DNT, so our Sites don't respond to DNT signals at this time.
Governing law
This Privacy Policy is governed by the laws of the State of New Hampshire, as well as applicable U.S. federal law. Please also see any damage limitations in our Terms of Use or other agreements.
Non-discrimination
You may not be discriminated against because you exercise any of your rights under the US State Privacy Laws.
Changes to this policy
We may update this policy from time to time. When we do, we'll post the new version here and show the new version date at the top. Unless we say otherwise, the current version applies to all information we have about you and your account.
